For valuable consideration and to induce permission to participate in the 2011 Help Ride collectively sponsored by Harley-Davidson, Inc., Harley-Davidson Motor Company, the Harley Owners Group, various authorized Harley-Davidson dealers including but not limited to Quaid Harley-Davidson, Inc. & Quaid Temecula Harley-Davidson, Inc., Golden Crown Productions, LLC and Old Town Temecula Association (hereinafter Collectively referred to as the “Sponsors”), the undersigned agree to the following terms and make the following warranties: I acknowledge that motorcycling is a HAZARDOUS RECREATION ACTIVITY with RISK of damage or PERSONAL INJURY, including PARALYSIS OR DEATH, to any person or property. Such hazards include burns, cuts, abrasions, punctures and fractures to any part of the human anatomy including head, back, neck and spinal cord as a result of, for example: falls, equipment failure, bad decision making, negligent or inattentive riders or pedestrians. I understand this is not a complete description of all risks and that other unknown or unforeseeable hazards and risks of harm may occur. With this in mind, I accept full responsibility for my own safety and the safety of any passengers and EXPRESSLY ASSUME ALL RISKS OF HARM, whether foreseen or unforeseen, and whether occurring while riding, or while merely participating and attending the 2011 Help Ride anywhere, at anytime. I hereby RELEASE and agree to INDEMNIFY AND HOLD HARMLESS the Sponsors and their respective shareholders, officers, employees, agents, instructors, patrons and participants, designers, equipment manufacturers, lessors, attorneys and insurers (hereinafter collectively referred to as “Released Parties”), from and against any liability, demand, claim or right of action for any damage or injury, including paralysis or death, to any person or property, even if such damage or personal injury results from the NEGLIGENCE of the Sponsors or Released Parties, I further COVENANT NOT TO SUE or make any demand or claim against the Sponsors or Released Parties, for or by reason of any such damage or personal injury from my participation and motorcycling activities at the 2011 Help Ride or anywhere, at any time. I will pay all fees, damages, and costs, including attorney's fees and expert fees, the Sponsors or other Released Parties may incur in the enforcement of this agreement. I am physically fit and know of no medical or health reason why I should not participate in this activity. I certify that my motorcycle/vehicle is registered and I carry motorcycle liability coverage with minimum limits of $15,000/$30,000 bodily injury and $10,000 property damage or statutory limit in the state of motorcycle registration. I further represent that I am at least 18 years of age and possess a valid motorcycle driver’s license. This Release extends to any and all past, present and future claims whether known or unknown by me which I have or later may have against the Sponsors or Released Parties which arise out of or are connected in any way to any act or omission of the Sponsors or Released Parties. I further agree to waive section 1542 of the California Civil Code, or any comparable state or federal law, which provides: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.". I intend this agreement to bind me and my family, my assigns, estate, heirs, and personal representatives. This contract is severable and shall be interpreted and enforced under the laws of the State of California. I have carefully read this document and fully understand its contents, which I adopt as a completely integrated and exclusive statement of the entire terms of agreement. I further state that I am not relying on any statements or representations made by the Sponsors or Released Parties.
